QUBALÉ — TERMS & CONDITIONS

These Terms & Conditions apply to purchases made through the Qubalé website and form part of the agreement between Qubalé and the client.

By placing an order, you confirm that you have read and accepted these Terms & Conditions.

Nothing in these Terms & Conditions limits or excludes any mandatory rights you may have under applicable consumer law.

1. ABOUT QUBALÉ

Qubalé is a jewellery brand based in the Netherlands.

2. OUR JEWELLERY

Qubalé creates fine jewellery handcrafted in Italy.

Most Qubalé creations are made to order and production begins after an order has been placed.

Our jewellery is crafted using materials including 18-carat gold, natural gemstones and diamonds, as specified on the relevant product page.

Product photographs are intended to represent our creations as accurately as reasonably possible.

However, natural gemstones are unique. Variations in colour, tone, pattern, inclusions and structure may occur and form part of the natural character of the stone.

These natural characteristics are not, in themselves, considered defects.

3. MADE TO ORDER

Most Qubalé creations are handcrafted to order in our family-owned atelier in Italy.

Made to order means that production of the creation begins after the client places an order.

Our usual production time is approximately 3–4 weeks, unless a different estimated production time is stated on the product page or communicated to the client.

Production times are estimates. If an unexpected material delay occurs, we will inform you as soon as reasonably possible.

The fact that a creation is made to order does not, by itself, mean that the client's statutory right of withdrawal is excluded.

4. BESPOKE & PERSONALISED CREATIONS

In addition to our regular made-to-order collection, Qubalé may create bespoke or personalised jewellery according to a client's individual specifications.

This may include, where applicable:

  • bespoke designs;
  • engraving;
  • custom dimensions;
  • individually requested modifications;
  • specially requested configurations; or
  • other personal specifications agreed with the client.

Where a creation is manufactured according to the client's individual specifications or is clearly personalised, the statutory exception to the right of withdrawal may apply.

Where this exception applies, the creation cannot be cancelled or returned on the basis of the statutory right of withdrawal.

We will make this clear to the client before the relevant purchase is completed.

This does not affect statutory rights relating to defective, damaged or non-conforming products.

5. ORDERS

By placing an order through our website, you are making an offer to purchase the selected Qubalé creation.

After placing your order, you will receive an electronic order confirmation.

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including an obvious pricing error, suspected fraud, inability to obtain required materials or circumstances that make fulfilment reasonably impossible.

If we cancel an order after payment has been received, the relevant amount will be refunded.

6. PRODUCT SELECTIONS

Please carefully check all selections before completing your order, including, where applicable:

  • ring size;
  • gemstone;
  • gold colour;
  • size;
  • chain length; and
  • any personalised specifications.

If you notice an error after placing your order, please contact us as soon as possible at info@qubale.nl.

If production has not yet started, we will do our best to accommodate a requested change.

Once production has begun, changes may no longer be technically possible or may result in additional costs.

We will inform you of any additional costs before carrying out a requested alteration.

7. PRICES

All prices displayed on the Qubalé website are shown in euros (€), unless otherwise stated.

For deliveries within the European Union, prices include VAT where required by applicable law.

Any applicable delivery costs or other mandatory charges will be clearly communicated before the order is completed.

For deliveries outside the European Union, import duties, taxes and customs charges may apply.

Unless explicitly stated otherwise at checkout, such charges are not included in the purchase price and are the responsibility of the recipient.

8. PAYMENT

The available payment methods are displayed during checkout.

Payment must be completed using one of the payment methods offered by Qubalé.

The client is responsible for providing accurate payment and billing information.

Payments may be processed by third-party payment providers in accordance with their applicable terms and privacy policies.

9. SHIPPING & DELIVERY

Once production is complete, Qubalé will carefully inspect and prepare the creation for shipment.

Orders are shipped securely using DHL Express or another appropriate delivery service.

Where available, tracking information will be provided after dispatch.

Please ensure that your delivery information is complete and accurate.

Estimated delivery times following dispatch may vary according to destination, customs procedures and circumstances outside our reasonable control.

Qubalé will comply with its statutory obligations concerning delivery.

10. RIGHT OF WITHDRAWAL

Where the statutory right of withdrawal applies, consumers generally have 14 days from receipt of the creation to notify Qubalé that they wish to withdraw from the purchase without giving a reason.

You may exercise this right using the methods made available by Qubalé, including by contacting us at info@qubale.nl, and, where applicable, through the online withdrawal function provided on our website.

Further information is available in our Returns & Exchanges Policy.

After exercising the right of withdrawal, the creation must be returned within the applicable statutory return period.

11. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The statutory right of withdrawal does not apply where an applicable legal exception applies.

This may include creations manufactured according to a client's individual specifications or creations that are clearly personalised.

Qubalé will not treat a creation as excluded from the right of withdrawal merely because it is produced after the order is placed.

Where we rely on the bespoke/personalised exception, this will be communicated clearly before the purchase is completed.

12. RETURNS

Eligible returns must be made in accordance with our Returns & Exchanges Policy and applicable consumer law.

The client should handle the creation only to the extent reasonably necessary to establish its nature, characteristics and functioning.

Returned creations should be complete and, where reasonably possible, accompanied by their original Qubalé jewellery box, pouch, certificates and accompanying items.

Where permitted by law, Qubalé may apply a reduction in the refunded amount if the creation has diminished in value as a result of handling beyond what is necessary to assess it.

Unless otherwise required by applicable law, the direct costs of returning an eligible creation are borne by the client.

13. REFUNDS

Where a consumer validly exercises the statutory right of withdrawal, Qubalé will refund payments in accordance with the applicable statutory requirements.

Where required by law, refunds will include the standard outbound delivery costs originally paid by the consumer.

Additional costs resulting from the consumer choosing a more expensive delivery method than our standard delivery method do not have to be refunded where permitted by law.

Refunds will normally be made using the same payment method used for the original transaction, unless otherwise agreed.

Qubalé may withhold reimbursement until the returned creation has been received or the consumer has supplied evidence of having returned it, where permitted by law.

14. DAMAGED, DEFECTIVE OR INCORRECT CREATIONS

Every Qubalé creation is carefully inspected before dispatch.

If you receive a creation that is damaged, defective or does not correspond with your order, please contact us at info@qubale.nl.

Please provide your order number, a description of the issue and, where possible, clear photographs.

Qubalé will assess the matter and provide an appropriate remedy in accordance with applicable consumer law.

Nothing in our Returns & Exchanges Policy or these Terms & Conditions limits your statutory rights regarding defective or non-conforming products.

15. STATUTORY GUARANTEE

Consumers are entitled to receive a product that conforms to the agreement and to what they may reasonably expect from it.

Your statutory guarantee rights apply independently of any Qubalé service, commercial warranty or return policy.

Where a creation does not conform to the agreement, the remedies available to you will be determined in accordance with applicable law.

Normal wear and tear, accidental damage, improper use, failure to follow reasonable care instructions and damage caused by unauthorised alterations are not, in themselves, manufacturing defects.

16. JEWELLERY CARE

Fine jewellery should be handled with appropriate care.

Gemstones and precious metals may be affected by impact, chemicals, cosmetics, perfume, chlorine, salt water or inappropriate storage.

We recommend following the Qubalé care instructions supplied with your creation or available through our Client Care service.

Damage caused by misuse or inappropriate care may fall outside Qubalé's responsibility where permitted by applicable law.

17. RESIZING, REPAIRS & ALTERATIONS

If you require resizing, repair or alteration of a Qubalé creation, please contact us.

We will assess whether the requested work is technically possible.

Additional costs may apply to work that does not fall within your statutory rights.

Any applicable costs will be communicated before the work is carried out.

Alterations carried out by an unauthorised third party may affect our ability to assess subsequent damage or defects.

18. INTELLECTUAL PROPERTY

All content on the Qubalé website, including jewellery designs, photographs, text, logos, graphics, brand elements and other creative material, is owned by or licensed to Qubalé unless otherwise stated.

Such content may not be copied, reproduced, distributed, commercially exploited or used without prior permission, except where permitted by law.

19. WEBSITE INFORMATION

We make reasonable efforts to ensure that product descriptions, photographs, prices and other information on our website are accurate.

Minor differences may occur between colours displayed on a screen and the appearance of materials in person.

Natural variations in gemstones are inherent to the materials we use.

If an obvious error occurs on our website, we reserve the right to correct it. Any rights you have under mandatory consumer law remain unaffected.

20. LIABILITY

Qubalé is responsible for loss or damage where and to the extent required by applicable law.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

Qubalé is not responsible for loss resulting from circumstances for which it cannot legally be held responsible.

Nothing in this section affects mandatory consumer rights.

21. FORCE MAJEURE

There may be circumstances outside our reasonable control that delay or prevent production or delivery.

Examples may include significant transport disruption, natural disasters, government restrictions, serious supply-chain disruption or other exceptional circumstances.

Where such circumstances occur, we will endeavour to inform affected clients and find an appropriate solution.

Your mandatory statutory rights remain unaffected.

22. PRIVACY

Personal information is processed in accordance with our Privacy Policy and applicable data protection legislation.

Please refer to the Qubalé Privacy Policy and Cookie Policy for further information about how personal data and cookies are used.

23. COMPLAINTS

If you have a question or complaint regarding a Qubalé creation or order, please contact us at info@qubale.nl.

We will endeavour to respond and find an appropriate solution within a reasonable period.

Your statutory rights and any applicable rights to seek independent dispute resolution remain unaffected.

24. APPLICABLE LAW

These Terms & Conditions and agreements with Qubalé are governed by Dutch law.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protection provided by the law that would otherwise apply to you.

Any dispute will be submitted to a competent court in accordance with applicable law.

25. CHANGES TO THESE TERMS

We may update these Terms & Conditions from time to time, for example following changes to our services, business operations or applicable legislation.

The Terms & Conditions applicable to your purchase are those that were made available to you when your agreement with Qubalé was concluded.
